1. Eligibility to Drive

1.1 You must be of legal age to drive the tuition vehicle and produce a valid UK/Northern Ireland provisional Category B driving licence at the beginning of your first lesson. Your instructor reserves the right to check your licence at any time throughout your ongoing lessons.

1.2 For refresher or Pass Plus lessons, a full valid driving licence must be produced along with identification as above.

2. Eyesight Requirements

2.1 During your first lesson, your instructor will test your eyesight. You must meet the minimum eye test requirements: reading a standard UK approved number plate at a minimum distance of 20.5 metres (67 feet).

2.2 If you need to wear glasses or contact lenses to meet this requirement, you must wear them whenever you drive.

2.3 A failed eye test will result in not being permitted to drive the tuition vehicle until the required standards are met.

3. Safety and Conduct

3.1 Student Conduct:  

Students are expected to conduct themselves in a safe and responsible manner at all times during lessons. This includes arriving on time, wearing appropriate footwear, and being free from the influence of alcohol, drugs, or any substances that may impair driving ability.

3.2 Instructor Authority:  

The instructor reserves the right to terminate a lesson if the student is deemed unfit to drive due to any of the following reasons: suspected alcohol or drug use, illness, fatigue, or any other condition that could compromise safety. In such cases, the lesson fee will still be chargeable.

3.3 Alcohol and Drug Policy:  

You must not be under the influence of alcohol or drugs during your training. If there are any signs of alcohol or drug misuse, your instructor will withhold the use of the tuition vehicle for lessons or your driving test until you are in a legal and fit state to drive.

3.4 Prescribed Medication:  

Any prescribed medication that may affect your driving should be declared to the instructor and to the DVLA medical board.

3.5 Behavioral Expectations:  

Both students and instructors are expected to maintain a respectful and professional demeanor at all times. Any form of harassment, abuse, or aggressive behavior may result in the immediate termination of lessons, with no refund.

4. Cancellations and Refunds

4.1 Cancellation of Lessons:  

To cancel a lesson, a minimum of 48 hours' notice must be given. Failure to give this notice will result in the lesson(s) being charged as though they went ahead. Lessons can be cancelled by telephone or text message but must be acknowledged by your instructor.

4.2 Instructor Cancellations:  

Your instructor will aim to arrive on time at the pre-arranged pick-up location. However, unforeseen circumstances such as breakdowns, accidents, test bookings, or traffic hold-ups may require lesson times to change or be cancelled. If your lesson is cancelled by your instructor, no fee will be charged, and you can re-book or ask for a refund.

4.3 Multiple Cancellations:  

If lessons are cancelled or rescheduled more than six times by you, your instructor reserves the right to charge for the lesson as if it had been conducted, regardless of the notice period provided.

4.4 Refunds:  

- Non-Refundable Deposit: A non-refundable deposit of 20% of the total lesson or package cost is required at the time of booking. This deposit secures your lesson times and is deducted from the overall cost of the package. In the event of cancellation, this deposit will not be refunded.

- Cancellation Fees:

    - If you cancel your booking within 48 hours of confirmation, you are entitled to a full refund, minus the non-refundable deposit.

    - If you cancel after 48 hours but before the first lesson has commenced, a cancellation fee of 25% of the total package cost will apply, minus the non-refundable deposit.

    - If you cancel after the first lesson has commenced, no refund will be given for the hours already used, and a cancellation fee of 40% of the remaining unused hours will apply.

- Rescheduling: Students may reschedule lessons without incurring a cancellation fee if at least 48 hours' notice is provided. Failure to provide adequate notice may result in forfeiture of the lesson. See section 4.3.

4.5 Refunds will be processed within 14 calendar days.

5. Payments

5.1 Payment Methods:  

Lessons should be paid for in advance by bank transfer. In exceptional circumstances, your instructor may agree to take cash payment at the start of any lesson.

5.2 Lesson Payment:  

All lessons must be paid for prior to commencing the lesson unless otherwise agreed. Payments must be acknowledged by your instructor.

5.3 Retention of Deposit:  

If you book lessons and then choose not to proceed, a 20% deposit of any bookings made will be retained by us, and the rest will then be refunded. This retention is due to the slots offered to you being unavailable to other students. See section 4.4.

6. Lesson Validity Period

6.1 All bulk lesson packages must be completed within six (6) months from the date of purchase. Any unused lessons remaining after this period will be forfeited and are non-refundable. Extensions may be granted at the discretion of the school, subject to availability and additional fees.

6.2 Any payments for lessons or package offers must be redeemed within six months of making the payment to us. It is your responsibility to contact your instructor in writing if you are unable to take any pre-arranged lessons within this period.

7. Tuition Vehicle

7.1 Vehicle Condition:  

Driving lessons will only be conducted in vehicles that are roadworthy and meet all legal requirements for driving in the UK. If a lesson is cancelled due to an issue with the vehicle provided by the school, it will be rescheduled at no additional cost to the student.

7.2 Vehicle Use:  

The tuition vehicle must be treated respectfully. Any damage caused due to irresponsible action may result in charges for the damages.

7.3 Irresponsible Action:  

Irresponsible action includes damage caused after it is agreed that you do not require assistance in a specific manoeuvre or driving exercise.

7.4 Instructor Substitution:  

In the event that your assigned instructor is unavailable due to illness or other unforeseen circumstances, a substitute instructor may be provided with your consent. If no substitute is available, your lesson will be rescheduled or refunded.

8. Test Cancellations

8.1 No responsibility can be taken for tests cancelled by the DVSA for any reason apart from severe weather. This time will still be charged.

8.2 Your instructor will be responsible if the test is cancelled due to the condition of the tuition vehicle.

8.3 If your test is cancelled at the last minute by the examiner due to an examiner issue or shortage, you will still be charged for this time. You can, however, claim this amount back from the DVSA.

9. Data Protection

9.1 We will handle your personal data in accordance with the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR).

9.2 Your personal information will be used solely for the purpose of providing driving tuition and any related services. We will not share your personal data with third parties without your explicit consent, except where required by law.

9.3 You have the right to request access to the personal data we hold about you and to request corrections of any inaccuracies.

9.4 Privacy and Confidentiality:  

Any personal information shared during lessons or communications between the student and instructor will be kept confidential and used solely for the purposes of delivering the driving tuition service.

10. Limitation of Liability

10.1 The driving school shall not be liable for any loss, damage, or injury sustained during a lesson, except where such loss, damage, or injury is caused by the negligence of the instructor. The school’s liability is limited to the value of the lesson in question. We will not be liable for any loss or damage suffered by you as a result of any cancellation or delay of lessons due to circumstances beyond our control.

10.2 We will not be liable for any indirect or consequential losses arising from the use of our services.

10.3 Insurance Coverage:  

The driving school provides comprehensive insurance coverage for all lessons, including third-party liability and damage to the vehicle. This coverage applies only when the student is driving under the supervision of a qualified instructor from the school.

10.4 Student Responsibility:  

While the school provides insurance coverage, students are expected to follow the instructor's guidance at all times. Any deliberate or reckless actions that result in damage or injury may result in the student being held liable for costs not covered by insurance.

11. Complaints

11.1 If you have any complaints about our services, please inform your instructor or contact us directly in writing. We will endeavour to resolve any issues promptly and fairly. You can contact us by writing to info@precisedrivingschool.com.

12. Amendment to Terms

12.1 The driving school reserves the right to amend these terms and conditions at any time. Any changes will be communicated to students by posting on the school's official website, www.precisedrivingschool.com.

13. Governing Law

13.1 These terms and conditions, and any disputes arising from them, shall be governed by and construed in accordance with the laws of England and Wales. Any legal proceedings related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Force Majeure

14.1 Neither the student nor the driving school shall be liable for any failure or delay in the performance of their obligations due to events beyond their reasonable control, including but not limited to acts of God, war, terrorism, pandemics, or other emergencies.

15. Behavioral Expectations

15.1 Both students and instructors are expected to maintain a respectful and professional demeanor at all times. Any form of harassment, abuse, or aggressive behavior may result in the immediate termination of lessons, with no refund.

16. Termination of Services

16.1 Either party may terminate the driving tuition agreement with a written notice of at least two weeks. Any lessons booked after this period will be refunded, minus the non-refundable deposit. The instructor reserves the right to terminate the agreement immediately if the student repeatedly violates the terms and conditions.
